Terms of Use

1. Acceptance of terms
By creating an account or using Clinicerto (the "Platform"), you ("Professional" or "User") agree to these Terms of Use. If you do not agree, do not use the Platform.
The Platform is provided by Clinicerto Tecnologia em Saúde Ltda. ("Clinicerto", "we", "us").
2. The service
Clinicerto is an electronic health records (EHR) system for licensed health professionals (physicians, psychologists, dentists, nutritionists, physiotherapists, and others) and the clinics they operate. The Platform enables recording consultations, clinical notes, patient data, appointments, and clinical documents.
Clinicerto is an administrative and documentation support tool. It is not a telemedicine service, does not replace the professional's clinical judgment, and is not responsible for therapeutic decisions.
3. Eligibility
- You must be at least 18 years old.
- You must be a legally licensed health professional or act under the supervision of one.
- Using the Platform to manage third-party patient data without authorization is prohibited.
4. Account and security
- You are responsible for maintaining the confidentiality of your access credentials.
- Notify us immediately of any unauthorized use of your account.
- Each account is personal and non-transferable, except for clinic accounts with multiple users.
5. Acceptable use
You agree not to:
- Use the Platform for illegal or unethical purposes.
- Record patient data without consent or a legitimate purpose.
- Attempt to access data belonging to other professionals or clinics.
- Engage in reverse engineering, scraping, or any form of automated data extraction.
- Transmit viruses, malware, or any malicious code.
- Use the Platform for spam, phishing, or any form of fraud.
6. Patient data and professional responsibility
As the controller of their patients' data (under Brazil's LGPD), the Professional is solely responsible for:
- Obtaining the necessary consent from patients for the processing of their data.
- Ensuring the accuracy and integrity of information recorded.
- Complying with applicable record retention periods and professional secrecy obligations.
- Informing patients about the use of electronic health record systems.
Clinicerto acts as a processor of this data and does not access its content for any purpose other than the contracted service.
7. Plans and payment
- Current plans and pricing are available on the pricing page.
- Billing is monthly or annual, per the chosen plan.
- In case of non-payment, the account may be suspended after notice.
- No refunds are issued for periods already used, unless otherwise required by law.
8. Intellectual property
Clinicerto and all its components (code, interface, brand, logo, documentation) are the property of Clinicerto Tecnologia em Saúde Ltda. and are protected by Brazilian intellectual property law.
Data entered by the Professional (including records and documents) remains the property of the Professional. We grant the Professional access to and export of this data upon request.
9. Availability
We make reasonable efforts to keep the Platform available 24/7. However, we do not guarantee uninterrupted availability. Planned maintenance will be communicated in advance when possible. We are not responsible for unavailability caused by factors outside our control (internet, cloud providers, force majeure).
10. Limitation of liability
To the maximum extent permitted by Brazilian law, Clinicerto is not liable for indirect, incidental, or consequential damages arising from use of the Platform. Our total liability shall not exceed the amount paid by the Professional in the 3 months prior to the triggering event.
11. Termination
- You may close your account at any time through the account settings.
- We may suspend or close accounts that violate these Terms, with prior notice when possible.
- After closure, data is available for export for 30 days, after which it is deleted per the Privacy Policy.
12. Changes to these Terms
We may update these Terms periodically. Material changes will be communicated by email at least 30 days in advance. Continued use of the Platform after that period implies acceptance of the new terms.
13. Governing law and jurisdiction
These Terms are governed by Brazilian law. For dispute resolution, the parties elect the courts of the city of São Paulo, SP, Brazil, waiving any other jurisdiction.
